Terms of sale

These are the terms you buy under when you order from this site. We've kept them short and in plain English. Nothing here takes away rights you have under the Australian Consumer Law — where these terms and the ACL disagree, the ACL wins.

1. Who you’re buying from

2. Prices

  • All prices are in Australian dollars and include GST.
  • Some items show “contact for price” rather than a figure — that's usually because our supplier sets the terms on which the price can be advertised. Ask us and we'll give you the price.
  • Trade and contract customers see their own agreed pricing once signed in. Those prices are for that account and aren't to be passed on as a retail price list.
  • We try hard to keep prices and stock right, but if an item is priced or listed in error we may cancel the order and refund you in full rather than supply at the wrong price. We'll always tell you before we do.

3. Placing an order

Adding something to the cart isn't a contract. Your order is an offer to buy; the contract forms when we accept it, which we do by confirming and starting to pick your order. Prices are re-checked on our side when you check out, so the amount charged is the current price for the goods in your cart.

If we can't supply something you've ordered, we'll contact you and either substitute it with your agreement or refund that line.

4. Payment

Card payments are taken through Stripe inside the checkout on this site. We never see or store your card number. Where an order is placed on account or for pickup and payment is arranged directly with us, the order is confirmed but not paid until we take payment.

5. Delivery

  • We deliver ourselves, so online orders are limited to Douglas Shire (Port Douglas, Mossman & surrounds). If your address is in our area but the checkout won't take your postcode, call us and we'll sort it out. We don't cross the Daintree River.
  • Delivery is free on orders of $100 or more; under that it's a flat $25.
  • We deliver on our own runs during business hours, and we'll be in touch about timing. Any date we give you is an estimate, not a guarantee.
  • Tell us in the delivery notes where to leave things if you won't be home. If you ask us to leave goods unattended, they're your risk from the moment they're left. Gas cylinders are never left unattended.
  • Risk in the goods passes to you on delivery. Title stays with us until they're paid for in full.

6. Gas — LPG and BOC

Gas is sold and delivered under the safety rules that apply to it, and those aren't negotiable:

  • LPG delivered to a property requires a valid gas compliance certificate for the installation. The checkout will ask for the certificate number if we don't already hold one for that address, and we can't supply without it.
  • Cylinders remain the property of the gas supplier and are supplied on exchange. Damaged, modified or out-of-test cylinders may be refused.
  • Gas isn't supplied to anyone under 18, and we may ask for ID.
  • BOC industrial and medical gases are ordered against a BOC account and are subject to BOC's own supply terms.

7. Trade accounts and quotes

Approved trade and wholesale accounts can order on account rather than paying at checkout. Those orders are invoiced, and payment is due on the terms agreed for that account. A quote saved from your account is an estimate at the prices current on the day; we'll confirm it before we supply.

8. Returns, cancellations and your consumer guarantees

You have guarantees under the Australian Consumer Law that we can't exclude. If goods are faulty, not as described, or don't do what they're supposed to do, you're entitled to a repair, replacement or refund — a refund for a major failure, and compensation for any other reasonably foreseeable loss. Tell us as soon as you can and we'll make it right.

Outside of that:

  • You can cancel an order at no cost any time before we've picked and dispatched it.
  • Change-of-mind returns are at our discretion. If we accept one, the item needs to be unopened, unused and in resalable condition, and we may deduct the delivery cost.
  • For safety reasons we can't take back opened pool chemicals or gas cylinders once they've left us. That doesn't affect your rights above if there's something wrong with them.

9. Water testing, dosing advice and product information

Our dosing guides, water-test results and the pool water check tool on this site are a guide based on the readings and pool volume given to us. They don't replace the directions and safety warnings on the product label — always follow the label, add chemicals separately, and never mix them. If a reading looks wrong, retest before dosing.

10. Liability

Apart from the consumer guarantees and anything else the law says we can't exclude, our liability for a problem with goods we've supplied is limited, at our option, to replacing them, supplying them again, or refunding what you paid. We aren't liable for loss caused by goods being used contrary to their label or to our written advice.

11. General

These terms are governed by the law of Queensland, and the courts of Queensland have jurisdiction. If part of these terms turns out to be unenforceable, the rest still applies. We may update these terms, and the version on this page at the time you order is the one that applies to that order.
